Can Workers’ Comp Force Me Into Surgery in Louisiana?

If you've been hurt at work in Louisiana, you're probably dealing with a mountain of stress. One common question injured workers ask is: Can workers' compensation force me to have surgery?

The short answer in Louisiana is: No, you cannot be forced into surgery. But that doesn't mean your decision won't come with consequences. Here's what you need to know about your rights, responsibilities, and options under Louisiana workers' comp laws.

Understanding Workers' Comp and Medical Treatment in Louisiana

Louisiana's workers' compensation system is governed by the Louisiana Workers' Compensation Act. This law provides injured employees with medical benefits, wage replacement, and other necessary care to help them recover and return to work.

Under Louisiana Revised Statutes § 23:1203, your employer (or their insurance carrier) must pay for “all necessary” medical services related to your injury. This can include doctor's visits, physical therapy, medications, and yes—even surgery. But just because a doctor recommends surgery doesn't mean you're legally required to go through with it.

Can Refusing Surgery Affect Your Workers' Comp Benefits?

Yes, it can—under certain conditions. While you have the right to refuse surgery, doing so may impact your eligibility for workers' compensation benefits if the refusal is deemed unreasonable.

If you refuse such treatment without a valid reason, your benefits may be limited or denied. However, refusing surgery does not automatically disqualify you from receiving compensation. Courts and insurers will examine whether your refusal was reasonable and consider such things as the risk of the procedure and the likelihood of success of the surgery.

You Have a Right to a Second Opinion

If a doctor working for your workers' compensation insurance carrier recommends surgery, you don't have to accept that recommendation without question. Louisiana law protects your right to make informed medical decisions.

Under Louisiana Revised Statutes § 23:1121(B)(1), you have the right to select your own treating physician in each medical specialty. If your chosen doctor disagrees with the need for surgery or suggests alternative treatment, their opinion can support your decision to decline the recommended procedure.

If your treating physician recommends surgery, the carrier or self-insured employer has the right pursuant to Louisiana Administrative Code § I-2711 to obtain a second opinion from a physician of their choice. Regardless of that second opinion, you are not obligated to undergo surgery. Certain procedures, such as spinal surgery, joint replacements, and coronary artery bypasses, typically warrant a second opinion. The cost of the second opinion and any necessary tests must be covered by the carrier/employer.

What If They Try to Terminate My Benefits?

If the insurance company stops your wage replacement or refuses to pay for future treatment after you decline surgery, you can challenge their decision. This would go before the Louisiana Office of Workers' Compensation Administration (OWCA).
