Insurance Company Tactics to Delay, Avoid, or Minimize Payments

It may not be a surprise that insurance companies often try to throw up roadblocks when they're asked to make good on one of their accident insurance policies in Louisiana. Filing a claim against an insurance policy can sometimes be the start of a long and frustrating experience as you wait for the insurer to pay what you believe you're entitled to receive. There are several common tactics that insurance companies will use to hold onto their money for as long as possible:

- Denying Claims. Insurers may refuse to process claims for any number of reasons. They may argue that you failed to provide evidence that you're entitled to be paid under the terms of the policy. Depending on the circumstances, they might argue that you share responsibility for the accident that resulted in your injuries and damages or that you're entirely responsible – even if the police report says otherwise. In some cases, they simply refuse your claim and won't consider it until you sue.

- Delaying Claims. If you make mistakes or provide incorrect information when making your claim, they can delay the process until those issues have been corrected. Another tactic is to argue that you have not provided enough support for the claim you're making and require you to gather and submit additional information. Sometimes, they will simply hold off paying in the hopes that you give up.

- Minimizing Payments. Insurance companies are in business to make money, not to pay it out. If you file a claim, they will often make an initial “lowball” offer in the hopes that you'll accept it and waive any future claims against the policy for that accident. In other cases, they will dispute the value of damaged goods or the costs associated with medical care and rehabilitation, offering to pay only part of the actual loss you suffered.

- Using Biased Experts. Insurance companies may hire biased medical and other experts who provide favorable opinions for the insurance company.

- Switching Insurance Adjusters. It is not uncommon for there to be multiple insurance adjusters that will handle your claim. This can cause great delays as each new adjuster needs time to review and become familiar with the case.
