When our children climb up into their school bus each morning, we rely on the bus driver and whoever owns the bus – whether it's the local school district or a private company – to get them safely to and from school. The vast majority of the time, that's exactly what happens, and our kids are returned home to us safe and sound each afternoon. Sometimes, however, our worst fears are realized, and we learn that their bus has been involved in a crash and one or more kids on the bus have been injured. In other cases, the school bus may hit and injure a child.
When either of these unthinkable situations happens, and a child is injured as a result, you as a parent may have a claim on their behalf for their medical expenses, their pain and suffering, their rehabilitation and care, and other types of damages.
Who is Responsible When a School Bus Injures a Child?
There are a number of parties that may be responsible for the injuries suffered by a child involved in a school bus crash or who was struck by a school bus. These include:
- The school bus driver
- The driver's employer
- The owner of the school bus, whether it's the school district, your child's private school, or a private company hired by your child's school or school district
- Another driver, if the bus was involved in a crash with another vehicle
- The bus manufacturer, if the incident causing your child's injury was caused by a faulty part or defect
- The company that serviced the bus, if the incident was caused by negligent service work
In some cases, there may be a combination of factors that contributed to your child's injuries, with different parties responsible for a different percentage of the damages.
